§ 1 Scope of Application

  1. These Terms and Conditions apply to all contracts for the purchase and delivery of digital content (e.g. e-books, software, graphics, music files, online courses, templates, etc.) concluded between a consumer or entrepreneur (hereinafter “Customer”) and us via this online shop.
  2. Deviating terms of the Customer shall not apply unless expressly accepted by us in writing.

§ 2 Conclusion of Contract

  1. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
  2. By completing the order process, the Customer submits a binding offer. We may accept this offer within 2 days by sending an order confirmation by e-mail or by providing the download link.
  3. The contract is concluded upon receipt of the order confirmation or provision of the download.

§ 3 Right of Withdrawal – Special Rule for Digital Content

  1. For contracts concerning digital content not supplied on a physical medium, the statutory right of withdrawal expires prematurely if:
    • the Customer has expressly consented that we begin performance before expiry of the withdrawal period,
    • the Customer has confirmed that they are aware that their consent causes them to lose the right of withdrawal upon the start of performance, and
    • we have provided the Customer with a confirmation of the contract including this information.
  2. During the checkout process, the Customer must therefore actively tick two separate checkboxes before the purchase button is enabled:
    • agreed to the **Terms & Conditions** and
    •  “For digital products: I strongly agree that the execution of the agreement starts before the revocation period has expired. I am aware that my right of withdrawal ceases with the beginning of the agreement.”
  3. The purchase button is only activated once both checkboxes are ticked.

§ 4 Prices and Payment

  1. The prices displayed at the time of the order apply (gross prices including statutory VAT).
  2. Payment can be made via the methods offered (e.g. PayPal, credit card, Klarna).
  3. The Customer’s account is charged immediately after conclusion of the contract.

§ 5 Delivery of Digital Content

  1. Delivery takes place immediately after conclusion of the contract and successful payment by providing a download link via e-mail and/or in the customer account.
  2. Unless otherwise stated, the Customer receives 5 download attempts and access for 365 days. The link expires thereafter for security reasons.
  3. The Customer is obliged to check the downloaded files for completeness and functionality without delay.

§ 6 Grant of Rights / License

  1. Unless expressly stated otherwise, the Customer receives a simple, non-transferable right of use for personal or internal business purposes only.
  2. Resale, distribution, public disclosure, or commercial exploitation of the digital content is prohibited.
  3. For software: No guarantee is given for compatibility with future operating system versions.
  4. The exact scope and conditions of the granted rights are determined exclusively by our Terms of Use, which form an integral part of the contract and are available here:  → Terms of Use

§ 7 Warranty and Liability

  1. Statutory warranty rights apply.
  2. Obvious defects must be reported immediately, at the latest within 14 days of provision.
  3. We shall be liable without limitation in cases of intent, gross negligence, injury to life, body or health, and under the Product Liability Act. In all other cases, liability is limited to typical and foreseeable damages.

§ 8 Copyright and Intellectual Property

All digital content is protected by copyright. Any unauthorized reproduction, distribution or public disclosure will be prosecuted under civil and criminal law.

§ 9 Data Protection

Personal data is processed in accordance with our → Privacy Policy.

§ 10 Applicable Law and Jurisdiction

  1. The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. If the Customer is a merchant, the place of jurisdiction is Cottbus.
